Who needs Mitigation Service?

Mitigation investigations must be conducted in all death penalty cases. As mandated by the Supreme Court of the United States in Wiggins v. Smith.

Most attorneys don’t realize that mitigation investigations are the key tool in defending any violent criminal charge.

Mitigation investigations should be conducted in all homicide cases, whether or not the client faces the death penalty, because in most states, first degree murder is punishable up to 100 years.

Mitigation investigations have proven to be highly effective in sex offense cases. The presentation of mitigating evidence is an ideal way to explain to the jury the social history and trauma of the defendant’s life. Sex offense cases are difficult for everyone involved, however, it is always important to research the background and mental health of the individual accused.

Mitigating evidence should not only be presented during a jury trial. It is also beneficial in negotiating plea bargains prior to trial, saving time for the attorney.
